The Role of the Holy Qur'an in Understanding the Maqasid al-Shari'ah
Abstract
The discourse on Maqasid al-Shari'ah has emerged as a pivotal paradigm in contemporary Islamic legal theory, offering a purposive approach to understanding divine injunctions beyond mere textual formalism. This research article undertakes a comprehensive investigation into the fundamental role of the Holy Qur'an as the primary source and epistemological foundation for comprehending the higher objectives of Islamic law. Unlike secondary sources which derive objectives through analogical or inductive reasoning, the Holy Qur'an presents explicit and implicit architectural principles that shape the very notion of human welfare, justice, mercy and equilibrium. This study argues that the Holy Qur'an does not only provide legal rulings but establishes a coherent moral and ethical universe wherein every commandment aligns with the preservation of essential necessities: faith, life, intellect, lineage and property. Through thematic analysis of key Qur'anic verses, the research demonstrates how the scripture employs various rhetorical and legislative techniques to unveil the rationale behind rulings. The paper also critiques reductionist approaches that isolate textual literalism from Maqasidi hermeneutics. Furthermore, it explores the dynamic interplay between the immutable divine text and the evolving human contexts, asserting that the Qur'anic worldview inherently accommodates flexibility without compromising ethical absolutes. By examining classical Tafsir and contemporary scholarship, this article concludes that any authentic theory of Maqasid must remain rooted in Qur'anic revelation, as it alone provides the teleological compass for ijtihad in an ever changing world. The findings reaffirm that the Holy Qur'an is not merely a legal code but a living source of ethical guidance whose objectives transcend time and geography, offering a holistic framework for individual and collective reform.
